On Friday, April 11, 28-year-old Tory Nabu was tragically struck and killed while crossing Kahului Beach Road near the Harbor Lights Condominiums. According to Maui police, the incident occurred around 8:46 pm as Nabu was walking from the ocean side of the road towards the condos. A 2017 Ford Fusion traveling in the Wailuku-bound lane hit him as he crossed. Nabu suffered critical injuries and was transported to Maui Memorial Medical Center, where he later died.
Nabu’s death marks the eighth traffic-related fatality on Maui so far this year and the third pedestrian death at night. Nabu’s passing came just one day after two others who died in two separate traffic incidents, a 1-year-old Makawao resident and a 43-year-old man named Julius Ponce. Earlier this year, 48-year-old Brian Sponberg of Kihei was also struck and killed while walking at night.
Maui’s Ongoing Traffic Safety Crisis
Traffic-related deaths continue to rise across Maui, drawing attention to the island’s increasingly dangerous road conditions, especially for pedestrians. With eight fatalities reported in less than four months – double the number from this time last year – there is a clear need for greater public awareness and infrastructure improvements to protect both drivers and pedestrians.
Nighttime conditions have been a factor in several of these incidents, particularly those involving pedestrians. Reduced visibility, driver distraction, and speeding all contribute to a heightened risk after dark. Authorities continue to urge drivers to exercise caution, slow down in residential neighborhoods, and remain vigilant when approaching crosswalks or pedestrian-heavy areas.
“Each of these lives lost is more than a statistic; the individuals were loved and valued members of the community,” says Brett Schreiber, a partner of Singleton Schreiber. “We extend our heartfelt condolences to the family of Mr. Nabu during this incredibly difficult time. Our firm has handled many cases like this, and we know the emotional and financial toll they take. We are here to help families seek justice and accountability when tragedy strikes.”
Legal Options for Families After a Fatal Pedestrian Accident
In the aftermath of a fatal pedestrian accident, surviving family members may have the right to pursue a wrongful death claim. These legal claims can help cover the financial and emotional hardships caused by the unexpected loss of a loved one. Compensation may include:
- Medical expenses incurred before death, including emergency care and hospitalization
- Funeral and burial costs, which can create sudden financial strain
- Loss of financial support if the deceased contributed to household income
- Loss of companionship and emotional suffering experienced by close family members
Families don’t have to face this process alone. A compassionate personal injury attorney can guide them through the legal system, investigate the crash, and work to hold the responsible parties accountable.
