Filing for Compensation After an Accident in New Mexico
After an accident like the one that occurred this past weekend in Albuquerque, those involved may be eligible to file a claim for compensation.
New Mexico is a pure comparative negligence state. This means that the amount of damages you are entitled to in a claim will be reduced by the percentage of fault you are given in the cause of the accident or injuries. Under the pure comparative negligence laws, you may still be able to recover compensation even if you are 99 percent at fault for your injuries.
Depending on the details and circumstances of the accident, both the driver and the motorcyclist may be able to file claims under the pure comparative negligence rules in New Mexico.
Common Causes of Motorcycle vs Vehicle Accidents
Unfortunately, motorcycle vs vehicle accidents are a common occurrence, however, they have the potential to be extremely dangerous. These types of accidents often cause serious injuries and may even end in death. This is due to how vulnerable motorcyclists are. Their bikes do not afford the same protection passengers in cars have, motorcyclists are much more exposed to the elements. Additionally, vehicles weigh significantly more than motorcycles, so the force of the impact is greater.
Common causes of motorcycle vs vehicle accidents may include:
- Speeding
- Distracted driving
- Driving under the influence of drugs or alcohol
- Reckless driving, such as ignoring red lights or stop signs
- Failure to properly check before changing lanes
- And more
Both drivers and riders can be responsible for causing these types of accidents. And it is up to both parties to practice safe driving behaviors to help prevent accidents.
“The team at Singleton Schreiber is relieved to hear the rider was transported to the hospital in stable conditions.
